TERMS OF PARTICIPATION & WAIVER Effective

Legally Binding Agreement: By registering for any program operated by KCLH Sports Enterprises LLC (dba SoCal Basketball Club), you (the "Parent/Guardian") agree to these Terms on behalf of the participating minor (the "Player").
1. NATURE OF THE ORGANIZATION (FOR-PROFIT) You acknowledge that SoCal Basketball Club (operated by KCLH Sports Enterprises LLC) is a for-profit organization, not a religious ministry or a 501(c)(3) non-profit entity. Payments, including spectator fees, uniform purchases, or attendance bonds, are not tax-deductible charitable contributions.
2. FEES & COSTS
Tuition: $0.00 Monthly Tuition (Subsidized by Community Sponsors).
Uniform Fee: $35.00 (Mandatory one-time purchase).
Spectator Fees: You acknowledge that the League charges admission fees at game venues ($15/Adult, $10/Child) to fund facility, operational, and referee costs.
College Fund Program: Enrollment in the $1,000 College Fund Program is included at no additional cost for all registered players. Award amounts are tiered by starting grade level. 3. ATTENDANCE, RSVP POLICY & LIQUIDATED DAMAGES
The Commitment: You agree to pay a refundable attendance performance bond of $100.00 to reserve your roster spot (the "Bond").
Minimum Participation Requirement: To be eligible for Bond return, the Player must complete a minimum of twelve (12) weeks of active participation. Dropping out, voluntarily withdrawing, or abandoning the roster before this minimum requirement is met will result in immediate forfeiture of the Bond.
Weekly RSVP & Timely Notice: You must RSVP 'Yes' or 'No' by 8:00 PM on the Monday preceding each game weekend via the League's official RSVP platform.
Late Arrival After RSVP Decline: Players who RSVP 'No' by the Monday deadline and subsequently arrive at a Saturday event without notice will be accommodated on a space-available basis only and are not guaranteed a roster spot or game time.
Liquidated Damages (Bond Forfeiture on No-Show): If the Player "No-Shows" (fails to appear after confirming availability, or fails to communicate an absence entirely), the actual damages to the Company (including roster disruption, replacement/referee coordination, sponsor dissatisfaction, and administrative burden) are impracticable or extremely difficult to fix with precision. You agree that forfeiture of the $100.00 Bond constitutes agreed liquidated damages and a reasonable estimate of anticipated harm, and is not a penalty.
Refund Window: Provided the 12-week minimum has been met and no forfeiture events have occurred, the Bond is eligible for return exclusively during the League's annual 'Refund Processing Window' (September 1–15), subject to the Parent submitting a formal timely request.
Bond Replenishment: A player whose Bond is forfeited due to a No-Show or policy violation must replenish the $100.00 Bond within 30 days to maintain their active roster spot and continued eligibility for the College Fund Award Program.
4. COMMERCIAL MEDIA RELEASE You grant SoCal Basketball Club the irrevocable right to use the Player's name, likeness, and image in photographs and video for commercial advertising, marketing, and promotional purposes (including Facebook/Instagram Ads). You waive any right to inspect or approve the finished product and acknowledge no compensation will be provided. You represent that you are the Player's parent or legal guardian and have the legal authority to grant this permission. You release any claims for invasion of privacy, misappropriation of likeness, or right of publicity arising from such use.
5. LIABILITY RELEASE ASSUMPTION OF RISK; RELEASE OF PARENT/GUARDIAN CLAIMS ONLY. BASKETBALL IS A PHYSICAL SPORT AND INCLUDES RISKS OF SERIOUS INJURY OR DEATH. YOU KNOWINGLY AND VOLUNTARILY ASSUME ALL RISKS OF PARTICIPATION, WHETHER ARISING FROM INHERENT RISKS OF THE SPORT OR FROM THE ORDINARY NEGLIGENCE OF THE RELEASED PARTIES.
TO THE FULLEST EXTENT PERMITTED BY LAW, YOU (THE PARENT/GUARDIAN), ON YOUR OWN BEHALF, RELEASE AND WAIVE ANY AND ALL CLAIMS YOU MAY HAVE AGAINST KCLH SPORTS ENTERPRISES LLC, SOCAL BASKETBALL CLUB, AND THEIR OWNERS, OFFICERS, EMPLOYEES, COACHES, VOLUNTEERS, AND AGENTS (COLLECTIVELY, THE "RELEASED PARTIES") ARISING OUT OF OR RELATING TO THE PLAYER'S PARTICIPATION.
THIS RELEASE DOES NOT RELEASE CLAIMS FOR GROSS NEGLIGENCE, RECKLESS OR WILLFUL MISCONDUCT, OR FRAUD. NOTHING IN THIS AGREEMENT IS INTENDED TO WAIVE ANY RIGHTS THAT CANNOT BE WAIVED UNDER CALIFORNIA LAW, INCLUDING ANY CLAIMS BELONGING TO THE MINOR PLAYER.
6. MEDICAL CONSENT You authorize League staff to secure emergency medical treatment for the Player in the event of injury or illness and agree to be financially responsible for all costs associated with such treatment.
7. COMMUNICATIONS CONSENT By registering, you consent to receive automated text messages (e.g., RSVP requests, reminders, schedules) from KCLH Sports Enterprises LLC. Consent is not a condition of purchase. Message & data rates may apply. Reply STOP to opt out.
8. PROGRAM MODIFICATIONS SoCal Basketball reserves the right to modify program schedules, locations, format, structure, and availability at any time with reasonable notice to registered players. SoCal Basketball reserves the right to introduce or modify program fees at any time with 60 days written notice to active players. Continued participation is subject to compliance with all program policies, including attendance requirements and code of conduct.
